We may collect, use, and are responsible for certain personal information that you provide if you voluntarily subscribe to our newsletter or emails, download free resources, register for a class, workshop, webinar, challenge, or live event, register for a retreat or other in-person event, purchase or enroll in a Program, create an account on our course platform or the Peak Performance Method® web application, complete assessments, workbook exercises, surveys, or questionnaires, use our AI Tools (described below), participate in our online communities or live sessions, submit a testimonial, leave comments, fill out any type of form, access private membership pages, or otherwise contact us via an online form or email.

The information collected may include your name, email address, social media handle, mailing address, phone number, billing and payment information, account username and password, professional information (such as your job title, employer, and industry), your responses to assessments, workbook exercises, questionnaires, and surveys, the content of your posts, comments, and messages, your conversations with our AI Tools, and your image, voice, and likeness when you participate in recorded sessions or events. If you register for an in-person event such as a retreat, we may also collect information we need to plan your participation, such as dietary restrictions, accessibility needs, emergency contact details, and travel arrangements. You are not required to provide any personally identifiable information to merely access or visit this Site.

Some information you choose to share with us, such as information about your health, stress, or well-being in a coaching context, or dietary or medical information for an in-person event, may be considered sensitive. We use this information only to provide the Program or event you requested, and by providing it to us you consent to our use of it for that purpose. Please share only what you are comfortable sharing.

We may collect domain information, your numerical IP address, the type of browser you use, which pages you view, and the files you request. We may also use “cookies” (small files saved on your hard drive by your web browser) to analyze website and advertisement performance, track user patterns, save information from your previous visits, and customize your experience. We will ask for your consent to allow us to use cookies.

We may also use the technological equivalents of cookies to collect information, such as social media pixels. These pixels allow social media platforms to track visitors to our website and tailor the advertising messages you see while using those social media platforms. We may use these pixels in compliance with the respective policies of the various social media providers. We may also use analytics and tag management tools, such as Google Analytics and Google Tag Manager, and the analytics features of the platforms that host our Programs, to understand how visitors use the Site.

If your browser sends a "Do Not Track" signal, only a generic cookie will be placed on your device while the website is accessed.

We, or our third-party vendors, may collect non-personal information through the use of these technologies. Nonpersonal information might include the browser you use, the type of computer you use, and technical information about your means of connection to this website, such as the operating systems and the Internet service providers utilized and other similar information. Our systems may also automatically gather information about the areas of our website that you visit, the search terms you use on this website, and the links you select from within this website to connect with other areas of the Internet.

If you are located in the European Economic Area (“EEA”), we are regulated under the General Data Protection Regulation which applies across the European Union and we are responsible as controller of that personal information for the purposes of those laws.

If you are located in the United Kingdom (“UK”), we are regulated under UK data regulations known as “UK GDPR.”

    1. Information Collected from Other Sources

We may also obtain information such as your name, email, social media handle, address, phone number, and/or billing information from other sources, such as the third-party platforms we use to host, sell, and deliver our Programs (for example, Kajabi, our payment processors, Zoom, Circle, Slack, and Facebook); social media platforms when you interact with our content or advertisements; scheduling and form tools; co-facilitators and partners for joint sessions or events; and, if you participate in a Program through your employer or another organization, that organization.

    1. Artificial Intelligence Tools

Some of our Programs include artificial intelligence features (“AI Tools”), including Julia AI and Boundary AI Chatbot, our proprietary AI chatbots, and AI features within the Peak Performance Method® web application. When you use an AI Tool, we collect the information you submit (your “inputs”) and the responses the AI Tool generates (“outputs”).

AI Tools are powered in whole or in part by third-party artificial intelligence providers, such as Chatbase. Your inputs may be transmitted to, processed by, and stored by those providers, whose own terms and privacy practices govern that processing. Your inputs and outputs are accessible to us, and we may review them after the fact for safety, support, quality assurance, compliance, abuse prevention, and enforcement of our Terms and Conditions of Use, and to operate, maintain, evaluate, and improve our Programs and AI Tools. Any use of your inputs for product development or for public or marketing purposes will be in de-identified or aggregated form.

Please do not submit to any AI Tool protected health information or details of any medical or mental health diagnosis or treatment; government identification numbers; financial account, card, or login credentials; confidential information belonging to your employer, clients, or any third party; or personal information about any other identifiable individual without that person’s authorization. No human reviews AI Tool responses before they are delivered to you, and AI Tools are not monitored in real time.

    1. Recordings, Photos, and Community Participation

We may record live sessions, trainings, workshops, group coaching calls, and events, and we may take photographs or video at in-person events. These recordings may capture your name or screen name, image, voice, likeness, and anything you share during the session. As described in our Terms and Conditions of Use, we may share recordings within the Program, in future programs, on our website, or in third-party forums we operate, and we may use your contributions, testimonials, and likeness in connection with our Programs and marketing. You may use a screen name or pseudonym when participating in our Programs and communities.

    1. How and Why We Use Your Personal Information

We collect personal information in order to send emails, including our newsletter and marketing communications; deliver our Programs, products, and services, including access to our course platform, the Peak Performance Method® web application, online communities, and AI Tools; complete customer transactions and process one-time payments, payment plans, and recurring membership payments; plan and host live, virtual, and in-person events, including retreats; provide customer service and coaching support; respond to refund and cancellation requests; offer contests and promotions; feature testimonials and success stories; enforce our Terms and Conditions of Use and protect our intellectual property; comply with legal, tax, and accounting obligations; advertise our Programs, including through social media platforms; and improve our Site, Programs, and AI Tools. We may use artificial intelligence to provide analysis and feedback based on the information you provided to us.

We may share your personal data with third parties to fulfill the uses identified above, including delivering products and services. These third parties may include:

  • course, website, and application hosting providers (such as Kajabi and Replit);
  • payment processors, which handle your card details on our behalf (we do not store your full payment card details ourselves);
  • email marketing, customer relationship management, scheduling, and form providers;
  • video conferencing and online community platforms (such as Zoom, Circle, Slack, and Facebook);
  • third-party artificial intelligence providers that power our AI Tools;

  • professional advisors, such as our accountants and attorneys.

Before you participate in any contest, special offer or promotion, we may request your permission to share your personal information with third parties engaged to assist with the contest, special offer or promotion. If you give us permission, we may also share your personal information with third parties for marketing and advertising purposes.

If you participate in a Program through an engagement sponsored by your employer or another organization, we may share limited information with that organization, such as your enrollment, attendance, and completion status, as provided in our agreement with that organization. We do not share the content of your coaching conversations, assessments, or AI Tool inputs with your employer unless you authorize us to do so or we are required to by law.

We reserve the right to transfer your personal information if we merge with or are acquired by a third party. We may release personal information as necessary to enforce our terms and policies, operate and manage our business, protect our rights or the rights and safety of others, or to otherwise comply with applicable laws, regulations or legal obligations.

Third-party recipients may be based outside the European Economic Area or the UK. For further information, including how we safeguard your personal data when this occurs, see Transfer of your information out of the EEA, UK below.

We will not otherwise share your personal information with any third party without your consent.

    1. Whether Information Has to Be Provided by You and Why

In some instances, you may be required to provide personal data. For example, we may need your name and email address to provide customer support, or your street address to deliver a product, or billing information to complete a purchase. We will inform you when we collect it whether you are required to provide the information to us.

    1. How Long Your Personal Information Will Be Kept

We will hold all client and customer personal data in our files for six years, or longer where we are required to do so by law (for example, for tax or accounting purposes). We will hold all non-client personal data until you let us know you would like for us to delete it or unsubscribe from our marketing contacts, which you are free to do at any time.

  1. Use and Transfer of Your Information Out of the EEA, UK

This Site is operated in the United States, and third parties with whom we might share your personal information as explained above are located in the United States and in other countries where those service providers operate. If you are located in the EEA, the UK, or elsewhere outside of the United States, please be aware that any information you provide will be transferred to the United States. By using this Site, participating in any of our Programs, and/or providing your information, you consent to this transfer.

Other countries do not have the same data protection laws as the EEA or UK. While the European Commission has not given a formal decision that these countries provide an adequate level of data protection similar to those which apply in the EEA, any transfer of your personal information will be subject to the derogation under Article 49 of the General Data Protection Regulation. This provision allows non-repetitive transfers concerning a limited number of data subjects and is designed to help safeguard your privacy rights and give you remedies in the unlikely event of misuse of your personal information.

If you would like further information, see “How to Contact Us” below. Except as described above, we will not transfer your personal data outside of the EEA or UK, or to any organization (or subordinate bodies) governed by public international law or which is set up under any agreement between two or more countries.
