TERMS AND CONDITIONS OF USE
JULIA ARNDT COACHING INC.
d/b/a Peak Performance with Julia
Effective as of October 31, 2026.
Please read these Terms and Conditions of Use ("TOU") carefully. You must agree to these TOU before you are permitted to use or purchase any Julia Arndt Coaching Inc. digital or downloadable resources, workbooks, planners, toolkits, self-paced and multi-module online courses, group coaching programs, memberships, subscriptions, classes, workshops, trainings, challenges, assessments, or artificial intelligence features, or enter any online private forum operated by Julia Arndt Coaching Inc. (for any purpose), whether on a website hosted by Julia Arndt Coaching Inc. or on a third-party website or application such as Kajabi, the Peak Performance Method® web application, Circle, Slack, Zoom, or Facebook (collectively the "Program").
If you do not agree with these TOU, you may not purchase or use the Program.
These TOU are entered into by and between you and Julia Arndt Coaching Inc., a California corporation doing business as Peak Performance with Julia, with a mailing address of PO Box 5906, Tahoe City, CA 96145.
As used in these TOU, the term "Releasees" is defined to include the following: (i) Julia Arndt Coaching Inc., its subsidiaries, affiliated companies, owners, members, managers, directors, officers, past and present employees, agents, coaches, facilitators, contractors, representatives, successors, and assigns (collectively the "Company"); (ii) any Company volunteers; and (iii) Julia Arndt, individually.
The Program
As part of the Program, you will receive the services and materials outlined on the web page, sales page, or checkout page where you register. The specific inclusions, duration, and format of each offer are those described at the point of purchase.
For clarity, and because these TOU cover several different types of offers, the following definitions apply throughout:
- "Flagship Programs" means the Company's multi-module, cohort-based, or group coaching programs, including The Peak Performance Method® and any successor or similar program.
- "Digital Products" means self-paced, instantly delivered, or downloadable products, including workbooks (such as The Aligned Woman Workbook), planners (such as the Peak Performance Planner), toolkits (such as The Confident Boundaries Toolkit), short self-paced courses (such as the 5-Day Time Management Course and Master Your Time: FreeSpace), templates, guides, audio, and video.
- "Memberships" means any Program offered on a recurring subscription basis, whether billed monthly, annually, or otherwise.
- "AI Tools" means the artificial intelligence features made available by the Company, including Julia AI and Boundary AI Chatbot, any AI chatbot or assistant, AI-assisted assessments or recommendations, and AI features within the Peak Performance Method® web application.
- "Free Resources" means any material the Company provides at no charge, including lead magnets, free downloads, free courses, newsletters, and podcast content.
The Company reserves the right to modify, update, substitute, or discontinue any Program curriculum, module, schedule, session time, facilitator, bonus, or delivery platform, provided that the Company will not materially reduce the core substance of a paid Program you have already purchased.
Unless a specific access period is stated at checkout, your license to access Program materials continues for so long as the Company continues to offer the Program.
"Lifetime access," where offered, means for so long as the Company continues to make that Program available, which may not be indefinite.
The Company reserves the right to offer additional Program elements from time to time, for any subgroup of participants. These additional Program elements are a bonus, not a part of the services included in the base version of the Program. The selection of the participants who may participate in any additional Program elements is at the sole discretion of the Company.
Free Resources are provided as a courtesy, are offered "as is," may be modified or withdrawn at any time, and create no obligation of any kind on the part of the Company.
Participants
If you wish to participate in another session of the Program in the future or purchase any other products, programs, or services from the Company, all terms of these TOU will continue to apply unless superseded by another agreement in writing.
The Program is intended and only suitable for individuals aged eighteen (18) and above. Some of the Content in the Program may not be appropriate for children. By purchasing or using the Program, you represent that you are at least eighteen (18) years old and legally able to enter into a binding contract. The Company hereby disclaims all liability for use by individuals under the age of eighteen (18).
Your account and access credentials are personal to you. You may not share or transfer your access or login credentials to another person. You may transfer your reservation for an in-person retreat to another guest by contacting the organizers before the retreat begins. Other Program seats may not be transferred unless the Company agrees in writing.
Payment
You agree to the fees and payment schedule selected at checkout. All fees are stated and payable in United States Dollars (USD) unless expressly stated otherwise.
Payment Plans
If you select a payment plan, you authorize the Company to charge each installment automatically on the schedule disclosed at checkout until the full balance is paid. A payment plan is a financing accommodation, not a subscription: electing a payment plan does not reduce the total amount owed, and your obligation to pay all installments survives your withdrawal from, or discontinued use of, the Program.
Memberships and Recurring Payments
If you enroll in a Membership or Subscription with recurring payments (“Membership”), the following terms apply to you. Upon registering, your first payment in the amount shown at checkout will be due, followed by recurring payments in the same amount. The recurring monthly or annual payment will be charged to your card on the same calendar day each month or year until you cancel. You may cancel at any time before the next month's or year's payment is charged, as outlined in the Cancellation section below. In the event you do cancel, any default or late payments will be due immediately.
YOU ACKNOWLEDGE THAT YOUR MEMBERSHIP RENEWS AUTOMATICALLY FOR SUCCESSIVE MONTHLY OR YEARLY PERIODS UNLESS CANCELED BY YOU OR THE COMPANY. EACH RENEWAL PERIOD SHALL RUN TO THE LAST DAY OF THE APPLICABLE MONTH OR YEAR IN WHICH IT WOULD OTHERWISE EXPIRE.
IF YOU DO NOT WISH TO RENEW, YOU MAY CANCEL EASILY, AS OUTLINED IN THE CANCELLATION SECTION BELOW.
The Company may change Membership pricing on not less than thirty (30) days' advance notice sent to the email address associated with your account. If you do not wish to continue at the new rate, you may cancel before the change takes effect.
Card Authorization and Processing
If paying by debit card or credit card, you give the Company permission to automatically charge your credit or debit card for all fees and charges due and payable to the Company, without any additional authorization, for which you will receive an electronic receipt. You also agree that the Company is authorized to share any payment information and instructions required to complete the payment transactions with its third-party payment service providers (e.g., credit card transaction processing, merchant settlement, and related services). The Company does not itself store your full payment card details.
Taxes
Stated prices are exclusive of any sales, use, value added (VAT), goods and services (GST), or similar taxes. You are responsible for any such taxes assessed on your purchase, other than taxes on the Company's net income, and the Company or its payment processor may collect and remit such taxes where required by law.
Late Payment and Default
If payment is not received when due, the Company reserves the right to terminate your participation in the Program and all Content, as defined below, immediately and permanently.
If you fail to make any payment in a timely manner or voluntarily withdraw from the Program at any time or for any reason, you will remain fully responsible for the full cost of the Program and, if applicable, all payments in any payment plan you have chosen, regardless of whether you continue to access or participate in the Program. The Company reserves the right to charge a late fee on all balances more than thirty (30) days overdue. You agree to reimburse the Company for all collection and/or legal fees and expenses necessitated by lateness or default in payment.
Refunds
The Company's refund policy varies by the type of offer you purchased. The subsection that applies to your purchase is the one that governs. If your purchase includes more than one type of offer in a bundle, the policy for the highest-priced component governs the bundle as a whole, and no partial refund is available for individual components of a bundle.
4.1 Flagship Programs - Conditional 30-Day Guarantee
This subsection applies to The Peak Performance Method® and any other group coaching Program the Company designates as a Flagship Program.
Your satisfaction with the Program is important. Because the Program only works if you do the work, the Company offers a conditional, show-your-work guarantee. In order to qualify for a refund, you must, within thirty (30) days of your date of purchase, complete all of the following:
- view, in full, at least the first four (4) modules of the Program;
- complete the workbook exercises, worksheets, or implementation assignments corresponding to those modules;
- provide information about the specific strategies from those modules that you tried and how or why they didn’t work for you; and
- submit your refund request as described below within the same thirty (30) day period.
Your refund request must be sent to [email protected] and must include (i) proof that you viewed the first four (4) modules and completed the corresponding exercises, in the form of your completed workbook pages or other reasonable documentation, and (ii) a written statement explaining what you expected to gain from the Program and what you did not receive.
If you request a refund but do not include your completed materials and your written explanation on or before the thirtieth (30th) day following your date of purchase, you will not be eligible for a refund.
The Company will NOT provide refunds for any request that comes more than thirty (30) days following the date of purchase. After day thirty (30), all payments are non-refundable, and you are responsible for full payment of all Program fees regardless of whether you complete the Program.
Please note: If you opted for a payment plan and you do not request a refund as outlined here, you are required to complete the remaining payments of your payment plan.
4.2 Digital Products - Non-Refundable Once Accessed
This subsection applies to all Digital Products, including The Aligned Woman Workbook, the 5-Day Time Management Course, Master Your Time: FreeSpace, the Peak Performance Planner, The Confident Boundaries Toolkit, and any other instantly delivered or downloadable product.
Because Digital Products are delivered instantly and in full, and because their entire value is transferred to you the moment you access them, all sales of Digital Products are final. Once you have accessed, viewed, downloaded, streamed, or otherwise received a Digital Product, no refund will be provided for any reason. Unless otherwise required by law, you acknowledge that the Company does not offer refunds for any portion of your payment for a Digital Product, and you will not receive a refund at any time.
By purchasing a Digital Product, you expressly request immediate access to it and acknowledge that, where applicable law would otherwise grant you a cancellation or withdrawal right for digital content, you lose that right upon accessing the Digital Product.
4.3 Memberships - No Refund of Amounts Already Charged
This subsection applies to all Memberships. You may cancel a Membership at any time as described in the Cancellation section below. Cancellation stops future billing; it does not refund amounts already charged. Membership fees are non-refundable and are not prorated, and you will retain access through the end of the then-current billing period for which you have paid. The Company does not provide refunds or credits for partial billing periods, for periods during which you did not use the Membership, or for failing to cancel before a renewal date.
4.4 Free Resources, One-on-One, and Corporate Engagements
No refund applies to Free Resources, as no payment is made. Refunds and cancellation for one-on-one, corporate, team, and organizational engagements are governed by the separate agreement applicable to that engagement, as described in Section 5, and not by this Section 4.
4.5 Provisions Applicable to All Refunds
Upon determining that you are entitled to a refund pursuant to this policy, the Company will promptly issue an instruction to its payment processor to issue the refund. The Company does not control its payment processor and will not be able to expedite any refund to the method of payment used to purchase the product or service.
If you receive a refund, that shall immediately terminate any and all licenses granted to you under these TOU. You shall immediately cease using the Content, defined below, and shall destroy all copies in your possession, including without limitation: video recordings, audio recordings, forms, templates, documents, slide decks, worksheets, and any other resources provided to you by the Company. In addition, you will lose access to private participant areas, AI Tools, and any community, and will no longer be permitted to participate in social media or community groups limited to paying participants.
All refunds are discretionary as determined by the Company. To further clarify, the Company will not provide refunds for requests made after the applicable deadline stated above, and all payments must be made on a timely basis.
The Company reserves the right, in its sole discretion, to determine how to manage a participant who violates these TOU. Therefore, if a participant disagrees with how the Company manages another participant and requests a refund, the Company will deny such request.
Furthermore, if a participant violates these TOU, the Company reserves the right, in its sole discretion, to offer the participant another opportunity to abide by these TOU. If a participant disagrees with the Company offering another participant a second opportunity to follow these TOU, no grounds for a participant to receive a refund would be created, and any request for a refund on this basis shall be denied.
If, in the Company's sole right and discretion, you persist with behaviors or actions that violate these TOU, the Company may terminate your access and participation in the Program without notice and without refund.
The Company may offer additional Program elements for certain subgroups of participants. The Company reserves the right, in its sole discretion, to offer participation in these additional elements to specific participants. If a participant is denied participation in these additional Program elements, no grounds for a refund would be created and any request for a refund on this basis will be denied.
The temporary or permanent unavailability, modification, or discontinuation of any Program element or service, AI Tool, bonus, guest session, or third-party platform does not create grounds for a refund.
You have agreed to the Company's clear and explicit refund policy before completing your purchase and agree that you will not file a fraudulent chargeback with your credit card company or payment processor. If a chargeback is found to be fraudulent, the Company reserves the right to refuse future transactions with you, report the fraudulent chargeback to credit reporting agencies and/or chargeback databases, recover all of the Company's expenses and attorneys' fees incurred due to your payment default, and take any other appropriate legal action.
Corporate, One-on-One, Team, and Organizational Engagements
These TOU govern individual purchases made directly by a participant. Where an employer, organization, association, or other entity engages the Company to deliver training, workshops, keynotes, facilitation, or coaching for its employees, members, or invitees, that engagement may be governed by a separate written proposal, statement of work, services agreement, or master services agreement executed between the Company and that entity. In the event of any conflict between these TOU and such a separate agreement, the separate agreement controls with respect to that engagement.
Individuals who participate in the Program through an employer-sponsored or organization-sponsored engagement must accept, and are nonetheless bound by, these TOU as a condition of their participation.
Nothing in these TOU obligates the Company to accept, quote, or perform any corporate engagement.
Intellectual Property Rights
Ownership of the Content
The words, videos, voice and sound recordings, training materials, frameworks, methodologies, assessments, prompts, design, layout, graphics, photos, images, information, materials, documents, data, databases, software, and all other information and intellectual property accessible on or through the Company website, the Peak Performance Method® web application, any third-party website or platform the Company may use to distribute or host the Program, and contained in e-mails sent to you by the Company, as well as the look and feel of all of the foregoing (the "Content") is the property of the Company and/or its affiliates or licensors, unless otherwise noted, and it is protected by copyright, trademark, and other intellectual property laws.
The Company may use artificial intelligence-assisted tools in the research, drafting, design, or production of certain Content. All such Content remains the property of the Company and is subject to these TOU in the same manner as all other Content.
The Company's Limited License to You
If you view, purchase, or access the Program or any of the Content, you will be considered the Company's licensee. For the avoidance of doubt, you are granted a revocable, non-transferable, non-sublicensable license to the Content for personal, non-commercial use only, limited to you only.
This means you may view, download, print, email, and use one copy of the Program materials or other Content for your own personal purposes or within your own business only.
You may not republish, reproduce, duplicate, copy, sell, display, disclose, distribute to friends, family, colleagues, or any other third party, or otherwise use any Content for commercial purposes or in any way that earns you or any third-party money (other than by applying the principles generally in your own business or role). You may not use the Content, in whole or in part, to create, deliver, or market any course, program, workshop, coaching offer, or other product or service that competes with the Program. By downloading, printing, or otherwise using the Content for personal use, you in no way assume any ownership rights of the Content - it is still Company property. Any unauthorized use of any Content shall constitute infringement.
You must receive the Company's written permission before using any of the Content for your own commercial use or before sharing it with others.
The trademarks, service marks, and logos displayed in the Content, including PEAK PERFORMANCE WITH JULIA and THE PEAK PERFORMANCE METHOD®, are marks belonging to the Company, unless otherwise indicated. Any use including framing, metatags, or other text utilizing these marks, or other marks displayed, is strictly prohibited without the Company's written permission.
All rights not expressly granted in these terms or any express written license are reserved by the Company.
Unauthorized Use
Your use of any Content other than that expressly authorized in these TOU or by a separate written assignment is not permitted ("Unauthorized Use"). Any breach of the Artificial Intelligence provisions in Section 7 constitutes Unauthorized Use. You agree to pay liquidated damages of five (5) times the total fees paid for the Program in the event of your Unauthorized Use, or a minimum of five thousand dollars ($5,000.00), whichever is greater, in addition to any legal or equitable remedies the Company may be entitled to pursue. This is not a penalty but an agreed liquidated damages charge for the Unauthorized Use.
You agree that any violation or threatened violation of the Intellectual Property Rights terms in these TOU would cause irreparable injury to the Company that may not be adequately compensated by damages, entitling the Company to obtain injunctive relief, without bond, in addition to all legal remedies.
Request for Permission to Use the Content
If you wish to use any of the Content, or any other intellectual property or property belonging to the Company, you should request permission in writing BEFORE you use the Content by completing the "Contact" form on the website or by sending an e-mail to [email protected].
If you are granted permission by the Company, you agree to use the specific Content that the Company allows and only in the ways for which the Company has given you its written permission. If you choose to use the Content in ways that the Company does not specifically give you written permission, you agree now that you will be treated as if you had copied, duplicated, and/or stolen such Content from the Company, and you consent to immediately stop using such Content and to take whatever actions the Company may request, by the methods and in the time frame that the Company prescribes, to protect the Company's intellectual property and ownership rights in the Program and Content.
Artificial Intelligence
7.1 No AI Training on the Content
You are strictly prohibited from uploading, inputting, submitting, transmitting, or otherwise making available any Content - including recordings, transcripts, slide decks, workbooks, worksheets, frameworks, assessments, prompts, and written or spoken material shared by the Company or by other participants - to any artificial intelligence, machine learning, large language model, or generative system, or to any website, platform, software, or database from which such Content could be accessed, indexed, scraped, or replicated by such a system – such as Claude, Gemini, or ChatGPT.
Without limiting the foregoing, you may not use any Content to train, fine-tune, ground, embed, index, benchmark, evaluate, or otherwise develop or improve any artificial intelligence or machine learning model, dataset, agent, assistant, or application, and you may not use any Content to generate derivative outputs of any kind.
The Company expressly reserves all rights in the Content with respect to text and data mining, machine learning, and artificial intelligence training, and expressly opts out of and withholds consent to any such use, including for the purposes of Article 4(3) of Directive (EU) 2019/790 on Copyright in the Digital Single Market and any comparable provision of the law of any jurisdiction.
Use of a generative AI tool as a personal study aid to summarize, reformat, or reflect on Content solely for your own individual use is permitted only where the tool you use does not retain your inputs or use them for model training, and provided you do not share, publish, or distribute the resulting outputs.
7.2 No AI Recording, Transcription, or Notetaking
Due to privacy, confidentiality, and intellectual property concerns, participants may not use artificial intelligence technology to record, transcribe, summarize, or take notes on any live session, training, workshop, class, coaching call, or webinar that is part of the Program. This prohibition includes, without limitation, AI notetakers, meeting assistants, and bots such as Otter.ai, Fireflies, Fathom, Read.ai, Zoom AI Companion, Microsoft Copilot, and any comparable tool, whether the tool joins the session as a participant or operates from your device.
Any such tool that joins a session will be removed, and repeated attempts to admit one are grounds for immediate termination of your participation in the Program and your access to the Content, without refund.
7.3 The Company's AI Tools
Some elements of the Program may include or be delivered through AI Tools, including an AI chatbot or assistant and AI features within the Peak Performance Method® web application. Your use of any AI Tool is subject to this Section 7.3 in addition to all other provisions of these TOU.
Informational and educational only. Outputs generated by the AI Tools are produced automatically by statistical models. They are provided for informational and educational purposes only. They are not personalized coaching from Julia Arndt, are not reviewed by a human before delivery to you, and do not constitute medical, psychological, therapeutic, mental health, legal, financial, tax, or other professional advice. Your use of any AI Tool does not create a coach-client, doctor-patient, therapist-client, attorney-client, or any other professional or privileged relationship.
No guarantee of accuracy. AI Tools can and do produce output that is inaccurate, incomplete, outdated, biased, internally inconsistent, or entirely fabricated, including output that appears confident and authoritative. The Company does not verify AI Tool output. You are solely responsible for independently evaluating and verifying any output before relying on it or acting on it, and you assume all risk of doing so. To the fullest extent permitted by law, the Company disclaims all liability arising from or relating to your use of, or reliance on, any AI Tool or its output.
Not a crisis or emergency service. AI Tools are not monitored in real time and are not a substitute for human coaching, medical care, or licensed mental health treatment. They must not be used for urgent, crisis, or emergency needs. If you are experiencing a medical or mental health emergency, contact your local emergency number or a licensed professional immediately.
Third-party AI providers. The AI Tools may be powered in whole or in part by third-party artificial intelligence providers and infrastructure. Information you submit to an AI Tool may be transmitted to, processed by, and stored by those third-party providers, whose own terms of service and privacy practices govern that processing. The Company does not control, and is not responsible for, the practices of those providers. Your use of the AI Tools constitutes your consent to such transmission and processing.
Your inputs. You are solely responsible for the information you submit to any AI Tool. You agree NOT to submit: protected health information or details of any medical or mental health diagnosis or treatment; government identification numbers; financial account, card, or login credentials; confidential or proprietary information belonging to your employer, client, or any third party; or personal information about any other identifiable individual without that person's authorization. You grant the Company a worldwide, royalty-free license to use your inputs and the corresponding outputs to operate, secure, maintain, troubleshoot, evaluate, and improve the Program and the AI Tools, provided that any use of your inputs for product development or public or marketing purposes will be in de-identified or aggregated form.
Availability. AI Tools are provided "as is" and "as available." They may be changed, limited, suspended, or discontinued at any time, with or without notice. Unless an AI Tool is expressly identified as a core deliverable on the sales page for a Program, it is a bonus feature and is not a material part of what you purchased, and its unavailability does not entitle you to any refund or credit.
Julia AI and Boundary AI Chatbot Tools
Julia AI and Boundary AI Chatbot are the Company’s proprietary generative AI chatbots and are two of the AI Tools covered by this Section 7.3. Julia AI and Boundary AI Chatbot are machines, not humans, and are not Julia Arndt or any other coach, counselor, therapist, doctor, lawyer, emergency responder, or licensed professional. As between you and the Company, the Company owns Julia AI, Boundary AI Chatbot, and their underlying models, training data, datasets, workflows, automation flows, prompt logic, and appearance, and the Company grants you a limited, non-exclusive, non-transferable, revocable license to use Julia AI’s and Boundary AI Chatbot’s outputs for your own personal and internal business purposes. Your inputs to Julia AI, Boundary AI Chatbot, and their responses are accessible to the Company, and the Company may review them after the fact for safety, support, quality assurance, compliance, abuse prevention, and enforcement of these TOU, and for service improvement and research and development in accordance with the license to your inputs above. No human reviews Julia AI’s and Boundary AI Chatbot’s responses before they are delivered to you, and Julia AI and Boundary AI Chatbot are not monitored in real time, so the Company has no obligation to monitor, review, intervene in, or respond to any conversation.
7.4 Prohibited AI Conduct
In addition to the restrictions above, you may not:
- use any AI Tool to generate or attempt to generate content that is unlawful, harassing, threatening, defamatory, obscene, discriminatory, infringing, or that violates any provision of these TOU;
- reverse engineer, decompile, probe, or attempt to discover the underlying models, system prompts, instructions, weights, or source code of any AI Tool;
- use prompt injection, jailbreaking, or any other technique intended to circumvent the safety controls, usage limits, rate limits, or content restrictions of any AI Tool;
- use scripts, bots, scrapers, or other automated means to access any AI Tool or to extract Content or outputs in bulk;
- resell, sublicense, or provide third-party access to any AI Tool, or use any AI Tool on behalf of or for the benefit of any person who has not purchased access; or
- use any AI Tool, its outputs, or the Content to develop, train, market, or operate any product, service, model, agent, or application that competes with the Program or the Company.
A breach of this Section 7 is a material breach of these TOU and entitles the Company to terminate your access immediately and without refund, in addition to all other remedies available to it, including the liquidated damages provided in Section 6.
Your License to the Company; Use in Testimonials and Marketing
By posting or submitting any material during the Program such as comments, posts, photos, designs, graphics, images, videos, questions, survey responses, or other contributions, you are representing to the Company that you are the owner of all such materials, and you are at least eighteen (18) years old. You are also granting the Company, and anyone authorized by the Company, an unlimited, royalty-free, perpetual, irrevocable, non-exclusive, unrestricted, worldwide license to use, copy, modify, transmit, sell, commercially exploit, create derivative works from, distribute, and/or publicly perform or display your contributions, in whole or in part, in any manner or medium, now known or developed in the future, for any purpose, and are granting the Company the right to make it part of the Company's current or future Program and Content. This right includes granting the Company proprietary rights or intellectual property rights under any relevant jurisdiction without any further permission from you or compensation by the Company to you.
You also consent to photographs, videos, and/or audio recordings, including teleconference calls, webinars, group coaching sessions, or other communications, that may be made by the Company during the Program that may contain you, your voice and/or your likeness. In the Company's sole discretion, the Company reserves the right to use these photographs, videos, and/or audio recordings and/or any other materials submitted by you to the Company or created by the Company in connection with your participation in the Program, without compensation to you at any time, now or at any time in the future.
You also grant the Company, and anyone authorized by the Company, the right to use your likeness and identify you as the author and individual depicted in any comments, posts, photos, images, videos, or other contributions created by you or the Company, or by name, email address, or screen name, for any purposes, including commercial purposes and advertising. You acknowledge that the Company has the right but not the obligation to use any contributions from you and that the Company may elect to cease the use of any such contributions in the Program or in the Content at any time for any reason.
This means you give the Company permission to use anything you submit or post in the Program or any third-party forum or website operated by the Company, or anything captured by the Company during your participation in the Program, including images in which your face is visible and recognizable.
Any testimonial, result, or experience shared by you and used by the Company reflects your individual experience and is not a guarantee of results for any other person, as set out in the Earnings and Results Disclaimer below.
Your Conduct
The Program is a "pitch free zone." You agree you will not pitch, promote, market, or sell any other products, groups, programs, services, or events to Program participants on any Company website or in any third-party forum owned, operated, or moderated by the Company, whether officially sanctioned by the Company or not. This means you agree not to form, or invite Program participants to join, any unofficial or "shadow" groups on social media or any other platform, or organize in-person meetups, based on interests or locality. You agree you will not invite Program participants to participate in events, such as a meetup, seminar, retreat, or training, without first receiving approval from the Company. You agree not to market, promote, or sell products or services such as coaching services, courses, supplements, wellness products, multi-level marketing offers, or other products or services to Program participants, unless you are authorized or requested to do so by the Company. You also agree not to contact other participants outside the Program, including by direct message or email, for the purpose of soliciting their business.
Please also choose carefully the materials that you upload, submit, or embed on any website operated by the Company and any third-party forums operated by the Company. Any material you post on the Company's website or in any third-party forums operated by the Company may become public.
You are responsible for the comments, posts, photos, images, videos, and other contributions you submit during the Program and for any liability that may result from any material you post. You participate, comment, and post material at your own risk. Any communication by you on the Company's website and in any third-party forums operated by the Company, whether by leaving a comment or participating in a chat, in a public or private forum, or other interactive service, must be respectful. You may not communicate or submit any content or material that is abusive, vulgar, threatening, harassing, knowingly false, defamatory, or obscene, or otherwise in violation of any law or the rights of others. You agree to post comments or other material only one time.
You are strictly forbidden from the following:
- Harassing, fighting with, or being disrespectful to other participants
- Causing damage to any Company website, application, or third-party forum operated by the Company
- Using any Company website, application, or third-party forum operated by the Company for any unlawful, illegal, fraudulent, or harmful purpose or activity
- Using any Company website, application, or third-party forum operated by the Company to copy, store, host, transmit, send, use, publish, or distribute any spyware, virus, worm, Trojan horse, keystroke logger, or other malicious software
- Using any Company website, application, or third-party forum operated by the Company to transmit, send, or deliver unsolicited communications including, but not limited to, communications for marketing or advertising purposes
- Systematically or automatically collecting or scraping data from any Company website, application, or third-party forum operated by the Company
- Taking pictures or screenshots of any comments, posts, pictures, materials, or any other content shared by the Company or other participants on any Company website, private participant forum, or third-party forum operated by the Company without permission from the original poster
- Sharing any private and proprietary information, screenshots, comments, posts, pictures, materials, or any other content posted or shared by other participants within the Program (including on the Company website or within private participant or third-party forums operated by the Company) with the public or anyone outside the Program, without permission
- Using discriminatory speech, hate speech, comments, or actions against other participants based on their sex, gender, age, ethnicity, race, national origin, religion, socio-economic status, disability, or other characteristic
If, in the Company's sole discretion, your conduct violates these TOU in any way, you agree that the Company may immediately and permanently terminate your participation in the Program and your access to the Content without refund.
The Company, in its sole discretion, may delete or modify, in whole or part, any post, comment, or submission on the Company's website and any third-party forums operated by the Company. The Company does not, however, have any obligation to monitor posts, comments, or material submitted by third parties. The Company neither endorses nor makes any representations as to the truthfulness or validity of any third-party posts, comments, or material. The Company shall not be responsible or liable for any loss or damage arising from such third-party content on the Company website or on any third-party forums operated by the Company.
Community Guidelines
The Company has created a community that is intended to foster a safe and judgment-free space for connection, conversation, learning, and growth, while also protecting the privacy, integrity, and well-being of all participants. Within the Company's community is the baseline expectation that all participants will treat one another with respect while offering encouragement and consideration in all interactions.
The Company may post separate guidelines regarding your behavior in any online community or forum, whether hosted on the Company's website or a third-party website, which may be updated from time to time. You agree that you are bound by those rules, and they are expressly incorporated into these TOU.
While the Company does its best to create a safe and welcoming space for all participants, the Company cannot guarantee that all participants will follow these guidelines. The Company, in its sole discretion, may remove any participant's comments, posts, content, or materials; however, the Company does not have a duty to review all participant comments, posts, content, and material shared within the Program, including those made in any participant communities. Therefore, the Company shall not be held liable for any participant's comments, actions, posts, content, or materials that result in another participant's trauma or discomfort.
Confidentiality
The Company is not legally bound to keep your information confidential. You acknowledge that your communications with the Company are not covered by any doctor-patient privilege or any other professional relationship protected by legal privilege.
You may use a screen name or pseudonym instead of your actual name for your participation in the Program, including when making public posts on the Company website and in third-party forums operated by the Company.
You agree that the Company shall not be liable for the disclosure of any of your information by another participant. You agree to keep all information you learn about other participants, their businesses, their employers, or their clients (as applicable), strictly confidential except in very rare circumstances where disclosure is required by law.
The Company may record live sessions or trainings and share them within the Program, in future programs, on the Company's website, or in third-party forums operated by the Company.
You agree you will not share any recordings or third-party forum postings outside the private participant areas. If the Company discovers you have done so, this will be grounds for immediate termination of your participation in the Program and access to the Content. The prohibition on artificial intelligence recording, transcription, and notetaking set out in Section 7.2 applies in full to all sessions.
- Live or In-Person Events
If you participate in any live or in-person event as part of the Program, you agree to observe and obey all posted rules and warnings, to follow any instructions or directions given by the Company through its employees, representatives or agents, and to abide by any decision of any                   Company staff or volunteers, or Company vendors or contractors, regarding your ability to safely participate in the event. You agree to always exhibit appropriate behavior and to obey all local, state and federal civil and criminal laws while participating in the any Company events. This includes, generally, respect for other people, equipment, facilities, and property. The Company may dismiss you, without refund, if your behavior endangers the safety of or negatively affects the event or any person, facility or property.
You consent to medical care and transportation in order to obtain treatment in the event of injury to you as the Company, volunteers or medical professionals may deem appropriate. These TOU extend to any liability arising out of or in any way connected with the medical treatment and transportation provided in the event of an emergency and/or injury.
You agree that you will not consume alcohol prior to any part of the event that involves physical exercise or activity or use any medicine or substance that will inhibit your mental or physical ability to safely participate in the event.
If you choose to consume alcoholic beverages during any part of the event, you must do so responsibly and only if you are over the age of twenty-one (21).
The Company is not responsible for any personal item or property that is lost, damaged or stolen during the Membership Program, including at any events.
Username and Password
To access certain features of the Program, including any private areas limited to paying participants and the Peak Performance Method® web application, you may need a username and password. It is your responsibility to inform the Company by emailing [email protected] if you are unable to access your account before the Program begins. You agree to keep your username and password confidential. You also agree to provide true, accurate, current, and complete information about yourself during the registration process. If the Company has reasonable grounds to suspect that you have provided false information, shared your username and password with anyone else, or forwarded any non-public material from the Program to any other person, the Company has the right to suspend or terminate your account and refuse any and all current or future use of the Program or any Content, in whole or part, without refund. Any personally identifiable information you provide as part of the registration process is governed by the terms of the Company's Privacy Policy, available at [INSERT LINK TO PRIVACY POLICY].
Termination
The Company reserves the right in its sole discretion to refuse or terminate your access to the Program and Content, in whole or in part, at any time, upon delivery of written notice. If you violate any provision of these TOU, the Company may terminate your participation in the Program immediately and without refund. In the event of termination, you are no longer authorized to access the affected portions of the Program or Content. The restrictions imposed on you in these TOU regarding the Program and its Content will still apply now and in the future, even after termination by you or the Company.
In the event of termination, any remaining installment (if applicable), default, or late payments will be due immediately.
Cancellation
14.1 Flagship Programs and One-Time or Payment-Plan Purchases
If you would like to cancel your participation in a Flagship Program, you must provide the Company with written notice (including by e-mail to [email protected]). Your access to the Program will be terminated upon your notice of cancellation. You will not be issued a refund for any remaining days or months of the Program after your cancellation, except where you separately qualify for a refund under Section 4.1. In the event you decide to cancel, any remaining installment, default, or late payments will be due immediately.
14.2 Memberships
IF YOU DO NOT WISH FOR YOUR PAYMENT AND PARTICIPATION IN A MEMBERSHIP TO RENEW, YOU MAY CANCEL AT ANY TIME THROUGH YOUR ACCOUNT SETTINGS, OR BY SENDING THE FOLLOWING EMAIL TO [email protected]:
Please cancel my participation in the [insert name] program.
I understand that by canceling, I will be removed from the online community and will lose access to all content and program benefits, but that I am still bound by all ongoing provisions in the Terms and Conditions which I agreed to when I registered.
Signed,
[Your Name]
WHILE YOU MAY CANCEL AT ANY TIME, YOU MUST SUBMIT YOUR CANCELLATION REQUEST BEFORE YOUR RENEWAL DATE IN ORDER TO AVOID BEING CHARGED FOR THE NEXT RENEWAL TERM.
Following your cancellation, you will continue to have access to the Membership through the end of the then-current renewal term, and any remaining default or late payments will be due immediately.
Personal Responsibility, Assumption of Risk, Release, and Disclaimers
You are voluntarily participating in the Program and assume all risk of injury, illness, damage, or loss to you or your property that might result, whether arising out of the negligence of Releasees or otherwise.
Your participation in the Program does not establish a doctor-patient, attorney-client, counseling, therapeutic, or accountant-client relationship - or any other professional relationship protected by legal privilege - between you and the Company, or any of its employees or contractors. Julia Arndt and the Company's coaches and facilitators are not licensed therapists, psychologists, physicians, dietitians, or other licensed health care providers, and nothing offered through the Program is therapy, counseling, medical advice, diagnosis, or treatment.
The Program and Content provide information, education, and coaching only, and do not constitute professional advice of any kind, including but not limited to financial, legal, medical, or psychological advice. None of the Program or Content prevents, cures, or treats any mental or medical condition, including burnout, anxiety, depression, or any stress-related condition. The Program and Content are not intended to be a substitute for professional advice that can be provided by your own accountant, lawyer, financial advisor, therapist, or medical professional. You are responsible for your own financial, legal, physical, mental, and emotional well-being, decisions, choices, actions, and results. You should consult with a professional if you have specific questions about your own unique situation. The Company disclaims any liability for your reliance on any opinions or advice contained in the Program.
You agree that you will not use the Program as a way of diagnosing or treating mental disorders as defined by the American Psychiatric Association. If you are in therapy or under the care of a mental health professional, you will notify and consult with that mental health care provider regarding your decision whether to work with a coach.
You acknowledge that, by engaging with the Company for the Program, you voluntarily assume an element of inherent risk, and knowingly and freely assume all risk and responsibility for injuries to any persons or damages to any property, and release, covenant not to sue, and hold Releasees harmless from any and all liability to you, your personal representatives, assigns, heirs, and next of kin, for any and all claims, causes of action, obligations, lawsuits, charges, complaints, controversies, damages, costs, or expenses of whatsoever kind, nature, or description, whether direct or indirect, in law or in equity, in contract or in tort, or otherwise, whether known or unknown, arising out of or connected with your participation in the Program, whether or not caused by the active or passive negligence of the Releasees. This release is not intended as an attempted release of claims of gross negligence or intentional acts by Releasees.
In the event that the release and hold harmless provision is held unenforceable for any reason, you agree to limit any damages claimed to the total amount paid by you to the Company for the Program in the twelve (12) months preceding the event giving rise to the claim.
Earnings and Results Disclaimer: You agree that the Company has not made and does not make any representations about the earnings, career outcomes, promotions, productivity, health, or other results you may receive as a result of your participation in the Program. The Company cannot and does not guarantee that you will achieve any particular result or earnings from your use of the Program, and you understand that results and earnings differ for each individual. Any testimonials, case studies, or examples shared reflect the experience of the individuals featured and are not a guarantee, promise, or projection of your results.
Any links to third-party products, services, or sites are subject to separate terms and conditions. The Company is not responsible or liable for any content on, or actions taken by, such third-party company or website. Although the Company may recommend third-party sites, products, or services, it is your responsibility to fully research such third parties before entering into any transaction or relationship with them. The Company may receive commissions, affiliate fees, or other compensation in connection with your purchase of certain third-party products or services that it recommends.
The Company tries to ensure that the availability and delivery of the Program and Content is uninterrupted and error-free. However, the Company cannot guarantee that your access will not be suspended or restricted from time to time, including to allow for repairs, maintenance, or updates, or as a result of the acts or omissions of a third-party platform, although the Company will try to limit the frequency and duration of any suspension or restriction.
THE INFORMATION, PRODUCTS AND SERVICES OFFERED ON OR THROUGH THE PROGRAM AND CONTENT, INCLUDING ALL AI TOOLS, ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE PROGRAM OR ANY OF ITS FUNCTIONS WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY PART OF THE COMPANY'S WEBSITE OR APPLICATION, INCLUDING PAGES LIMITED TO PAYING PARTICIPANTS, OR THE SERVERS THAT MAKE THEM AVAILABLE, ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST REVENUE, OR LOST DATA, THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE PROGRAM, INCLUDING ITS CONTENT, AI TOOLS, PRODUCTS OR SERVICES, OR THIRD-PARTY MATERIALS, PRODUCTS OR SERVICES MADE AVAILABLE THROUGH THE PROGRAM. IN NO EVENT SHALL THE COMPANY'S TOTAL AGGREGATE LIABILITY EXCEED THE TOTAL AMOUNT PAID BY YOU TO THE COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Security
You acknowledge that there is an inherent risk in all forms of electronic communication, and communications between you and the Company may be unlawfully intercepted by third parties not under the Company's control. The Company does not guarantee the security of any information transmitted via the Internet, telephone, video conference, artificial intelligence interface, or other electronic media. Any efforts you undertake to communicate with the Company are done at your own risk.
Legal Disputes and Waiver of Class Actions
These TOU shall be governed by and construed in accordance with the laws of the State of California without giving effect to its conflict of laws principles. The state and federal courts located in or nearest to Placer County, California shall have exclusive jurisdiction over any case or controversy arising from or relating to the Program or Content, including but not limited to the Company's Privacy Policy or these TOU. By participating in the Program or using the Content, you hereby submit to the exclusive jurisdiction and venue of these courts and consent irrevocably to personal jurisdiction in such courts and waive any defense of forum non conveniens. The parties waive any right to bring claims as part of a class or collective action and agree to limit any litigation to individual claims they may have against one another. The prevailing party in any dispute between the parties arising out of or related to these TOU, whether resolved by negotiation, mediation, or litigation, shall be entitled to recover its attorneys' fees and costs from the other party.
Users Outside the United States
The Company controls and operates the Program from offices in the United States. The Company does not represent that the Program or its Content are appropriate or available for use in other locations. People who choose to access the Program from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. Nothing in these TOU limits any non-waivable right you may have under the mandatory consumer protection law of your country of residence.
Indemnification
You agree to defend, indemnify, release, and hold harmless the Company and any directors, officers, agents, contractors, partners, assigns, successors-in-interest, and their employees from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including but not limited to attorneys' fees) arising from or in connection with: (i) your use of the Program or Content in violation of these TOU, (ii) any breach by you of these TOU or any representation and warranty made by you herein, (iii) any comment, post, or material you submit to the Company's website, application, or any third-party forum or website operated by the Company, (iv) your use of materials or features available on the Program or Content, including any AI Tool or its output (except to the extent a claim is based upon infringement of a third-party right by materials created by the Company), or (v) a violation by you of applicable law or any agreement or terms with a third party to which you are subject, including your employer.
Force Majeure
The Company shall not be deemed in breach of these TOU if the Company is unable to provide access to the Program or any portion thereof by reason of fire, earthquake, labor dispute, act of God or public enemy, epidemic, pandemic, death, illness or incapacity of the Company or of Julia Arndt, failure or outage of a third-party platform or artificial intelligence provider, or any local, state, federal, national, or international law, governmental order, or regulation, or any other event beyond the Company's control (collectively, a "Force Majeure Event"). Upon occurrence of any Force Majeure Event, the Company shall give you notice of its delay or inability to provide access to the Program and may offer a revised schedule, alternative arrangements, or, if necessary, terminate these TOU.
General Provisions
The Company may modify the terms of these TOU at any time. All modifications shall be posted on the Company's website and, for material changes, participants shall be notified via email before the changes go into effect. Your continued use of the Program after the effective date of a modification constitutes your acceptance of the modified TOU. If any provision of these TOU is held invalid or unenforceable, the remainder of these TOU will remain in full force, and the invalid or unenforceable provision will be replaced by a valid or enforceable provision that most closely reflects the original intent.
No failure or delay by the Company in exercising any right under these TOU constitutes a waiver of that right, and no waiver of any breach shall be deemed a waiver of any subsequent breach.
You may not assign or transfer these TOU or any of your rights or obligations under them, except that a reservation for an in-person retreat may be transferred to another guest as described in these TOU. The Company may assign these TOU, in whole or in part, to any successor in interest, including in connection with a merger, acquisition, or sale of assets.
The provisions of these TOU relating to Payment, Refunds, Intellectual Property Rights, Artificial Intelligence, Your License to the Company, Confidentiality, Personal Responsibility and Disclaimers, Indemnification, Legal Disputes, and this General Provisions section survive the termination or expiration of these TOU and your participation in the Program.
Notices to the Company shall be sent to [email protected] or to PO Box 5906, Tahoe City, CA 96145. Notices to you will be sent to the email address associated with your account, and you are responsible for keeping that address current.
Nothing in these TOU creates any partnership, joint venture, employment, franchise, or agency relationship between you and the Company.
These TOU, together with any separate written agreement applicable to a corporate engagement and the Company's Privacy Policy, constitute the entire agreement of the parties and reflect a complete understanding of the parties with respect to the subject matter. These TOU supersede all prior written and oral representations.
